MADRAS HC ORDERS FOR COMPULSORY INITIATION OF MEDIATION IN ILAIYARAAJA STUDIO ROW

    In a significant development in the Madras High Court, the impending 2019 dispute between acclaimed musician Ilaiyaraaja and Prasad Studios over the Recording Theatre Number – 1, popularly known as Ilaiyaraaja recording theatre, has taken a new turn. This dispute is related to the vacation of the premises of this recording theatre which has been occupied by Ilaiyaraaja since more than the past four decades. The petition was filed by Ilaiyaraaja in lieu of his forceful eviction from the theatre. As reported in the Hindu, the petitioner has claimed lawful occupation of the premises for more than 42 years, and now under the guise of development of the property, the studio owners have asked for an eviction. The petitioner had raised these revision proceedings before the high court in lieu of the trial court being lackadaisical in its approach to dispose of this case and it being pending in the XVII Assistant City Civil Court in Chennai. The petitioner i.e. Ilaiyaraaja had sought a direction of expediated and speedy trial in the trial court with an interim injunction in his favor.

    The High Court presided by Justice V. Bharathidasan has directed this dispute for mediation at its mediation and conciliation Centre before passing any orders in this revision petition. The date for the same has been fixed at 9th December with a report to be produced before the court by the 13th. The Judge did the same upon a submission by Ilaiyaraaja’s counsel of a chance of a settlement being possible. It is post the mediation, and on occasion of no settlement being agreed upon, that this court would interfere in this petition.
