DELHI HIGH COURT RESTRAINS ‘DREAM11 TEAM’ FROM USING DREAM11 LOGO OR ANY DECEPTIVELY SIMILAR TRADEMARKS

In a plea filed by Sporta Technologies Private Limited’s (“Plaintiff”) , the Delhi High Court vide its order dated September 2, 2020 restrained defendants ‘Dream 11 team’  (“Defendant”) from using the logo or any other trademark, which are “deceptively similar” to that of the Sporta Technologies Private Limited’s trademarks and logo. Dream11.com  is a fantasy sports platform based in India that allows users to play fantasy cricket, hockey, football, kabaddi and basketball. Read order here.

Justice Rajiv Shakdher held that the defendant Dream11 team, its proprietor, partners, employees, and agents should restrain from using the mark “Dream 11” and the logo set or any other trademark or logo similar to the plaintiffs’ trademarks and logo. Further, the Delhi High Court has directed the defendant to take down the infringing material from its social media pages.

The registration of the aforementioned trademark was obtained on May 28, 2009, by the Plaintiff and they claim to operate a website www.dream11.com. The plaintiffs were aggrieved by the fact that the defendant had slavishly adopted an identical trademark and trade logo and, therefore, had created confusion in the minds of the consumers.

The Court also directed that the Internet domain registrar and web hosting company “GoDaddy, LLC  be arrayed as a party. Since the counsel on behalf of GoDaddy accepted service to be arrayed as a party, the Court directed them to suspend/block the defendant’s domain name website www.dream11team.com.

The matter is listed for hearing on October 6th 2020.
