The Court observed that Zepto had established a strong prima facie case based on its prior adoption, extensive use, and registrations of the “ZEPTO” mark across multiple classes. It further held that the defendants’ use of the impugned marks was likely to cause confusion and create an association with the plaintiff’s well-known quick commerce business. The plaintiff contended that the defendants were using an identical trade name, operating a website under the domain name asiapaints.in, and maintaining social media pages and e-commerce listings that were likely to mislead consumers into believing that their products were associated with Asian Paints.
